House-Hut Direct – Terms and conditions.

  1. Introduction
    1.1 This agreement (“the Agreement”) is made between House-Hut Estate Agents (“House-Hut”, “We”, “Us”, “Our”) and the Seller (“You”, “Your”).
    1.2 By entering into this agreement You are confirming you have read these Terms and Conditions and agree to them.
    1.3 You agree to House-Hut publishing your advert details on our web site and the web sites of our partners.
    1.4 You may request we stop advertising your property at any time either by email or in writing. On receipt of such request the details of the property will be removed from our sites within two working days and our agreement with you will end. If You subsequently wish us to re market your property a new fee will be payable.
    1.5 You agree to pay House-Hut a fee of £500 plus VAT prior to Our visit to your property to prepare details.
    1.6 House-Hut will only offer this agreement if We have not visited your property and provided You with a free market appraisal.
    1.7 Any extra products purchased must be ordered prior to, or at the time of Our visit to Your property to avoid additional visit charges.
    1.8 Additional site visits if required will be charged at the current rate published on Our website at the time of booking the visit.

  2. Your Responsibilities

    2.1 You have the legal right to sell or rent the property.
    2.2 You will check the property description provided and confirm that to the best of your knowledge it is true and accurate and not misleading.
    2.3 You will notify House-Hut of any changes made to the property during the marketing period.
    2.4 You will pay the full fee before the property details are taken and before the property is marketed.
    2.5 If you have a contract with another Estate Agent or subsequently sign up with another agent you have independently checked your contract with regards to the terms and conditions under which you must pay the Estate Agents commission. If later it is found that you are legally bound to pay another Estate Agents commission House-Hut will not be liable.
    2.6 Only one property may be marketed per agreement.
    2.7 You must provide us with a telephone number on which we can contact you and advise us if you change this number, or of any new numbers you wish us to use to contact you.
    2.8 You must provide us with a valid email address and agree to us communicating with you via this address.
    2.9 You will conduct viewings for the advertised property, which we will arrange for you at a convenient time to you.
    2.10 You will inform House-Hut once the advertised property is sold.
    2.11 Although House-Hut will assist you with making arrangements for the hand over of the keys to your property on completion of the sale you will be responsible for the actual hand over of the keys.
    2.12 The vendor agrees for a ‘For Sale Board’ to be erected at the property throughout the duration of the agreement except where a ‘For Sale Board’ is prohibited by law.

  3. House-Hut’s Responsibility
    3.1 We will prepare a brochure of your property to include a minimum of 9 pictures and once approved by You the brochure will be made available to the public via Our website.
    3.2 We will advertise your property on our website and partner websites within 2 working days of Your approval of the draft particulars (subject to EPCs and other government legislation being complied with). Publication on partner sites may be subject to alteration or cancellation according to changes in service imposed on us by those partner sites. As such we cannot guarantee unlimited publication on these sites.
    3.3 Our services are purchased for up to six months or until sold which ever is the sooner. After which House-Hut will have the right to discontinue the advert which includes the re-advertising on partner sites.
    3.4 We will supply a ‘For Sale’ board within 10 working days.
    3.5 We will deal with all email and telephone enquiries received concerning your property.
    3.6 We will arrange viewings with you when requested by buyers.
    3.7 We will inform you of any offers received and in discussion with you negotiate on your behalf to get you the best price for your property.
    3.8 Once an offer is accepted we will communicate the details of the offer to both your and your buyer’s solicitor.
    3.9 We will, to the best of our efforts, ensure that the House-Hut web site is available at all times. We reserve the right to take the site ‘off-line’ without prior notice for essential maintenance and upgrades.
    3.10 We will provide a help line for advice Monday – Friday 9.00am – 5pm and Saturday 9.30am – 1pm. If We are not available to take your call We will endeavour to call You back as soon as possible.
    3.11 We will provide You with access to a personal marketing page where you can access information about the marketing of your property.
    3.12 We may offer the following services to prospective purchasers and similarly the services may be offered to them by another organisation in circumstances where We may financially benefit: a) Valuation/survey conveyancing and estate agency services. b) Provision of financial services including but not limited to mortgages, insurance and pensions.
    3.13 If you instruct us to withdraw Your property from the market at any time our agreement with You ends at that point in time. No refund is payable under any circumstances. Should you subsequently decide to re-market your property with us a new fee will be payable.
    3.14 If your property is in BA, BS or SN postcodes we will provide you with a ‘For Sale Board’ as part of your package.
    3.15 We can provide a ‘For Sale Board’ if your property is outside these areas at a cost of £50.00 + VAT which must be paid prior to erection. Once erected the board then becomes your property and You will be responsible for its disposal when no longer required.

  1. Refunds
    4.1 You may cancel this contract by informing House-Hut in writing or email at least 24 hours before we visit your home to prepare details.
    4.2 Once we have visited your property to prepare your details no refund is payable.
    4.2 Under no circumstances will our liability exceed the value of advertising fee received.
    4.3 This does not affect your statutory rights as a consumer.
